Advance Directives: Ensuring Compliance

Advanced care planning involves patients making decisions about the medical care they will receive should they become unable to speak for themselves. Hospitals must follow certain requirements for both CMS and the Joint Commission in order to comply with regulations and standards. Hospitals must also comply with the Patient Self Determination Act which requires hospitals to inform patients of their rights under state law regarding medical care decisions.

  • Describe the CMS CoP requirements for advance directives for hospitals.
  • Describe the Joint Commission standards on advance directives.
  • Explain what is required of hospitals under the Patient Self Determination Act.
  • Discuss which patients must and should be provided with information on the hospital's advance directive policies in the CMS CoP hospital manual.
